Haley has owned his home near the xAI turbines for 20 years and never thought of himself as an activist. He filed the noise lawsuit earlier this year.
Foust lives near Haley, says his elderly neighbors have just agreed to sell, and says he won't take the offer because of its no-lawsuit condition.
The mayor says the development will bring tax revenue and that city monitors have not found a breach of the 70 decibel noise limit.
xAI denies the noise allegations. It says it has varied power output and built sound-dampening walls, and its letter says MZX requires property for its business purposes.
